Mother blames hospital and doctors for son’s condition

Nov 5, 2012 | Hospital Negligence

Most New Yorkers know that when someone is in need of emergency medical treatment, time is of the essence. A matter of minutes can mean the difference between life and death. In addition to appropriate care and treatment, patients and their family members expect that physicians will provide that treatment in a timely manner.

A mother in another state is accusing two hospitals and physicians at those hospitals of negligence. She claims they failed to provide her son with appropriate treatment when he was brought in for massive brain injuries after an attack outside a bar.

The attack happened three years ago. The now 29-year-old man was waiting for a ride home when he was punched twice. The man who allegedly threw the punches has been charged with aggravated battery. The attack left the victim blind and paralyzed.

The man’s mother has filed a lawsuit against two hospitals and two doctors who treated her son. She says the hospitals did not have a neurosurgeon on call. In addition, they failed to effectively communicate with first responders and with doctors at either hospital. She says physicians were also not aware of her son’s brain injuries. The family is seeking $200,000 in damages.

Most people in New York City and beyond hope that they will never need emergency medical treatment. However, no one can ever know for sure if and when they will ever need it. People can only trust that the medical professionals who help them in those instances will provide them with proper care. When a medical professional fails to do that, they should be held responsible.
