Family files lawsuit after young boy is wrongly declared dead

Imagine being told that your young son is dead and then learning hours later that he is still alive. That is what happened to one family, and they are now attempting to hold a hospital responsible for their negligence.

The 8-year-old boy involved in the incident has suffered the effects of brain damage for most of his life. In February, his mother found him unresponsive. He was taken to a nearby hospital where doctors pronounced him dead.

The family began making funeral arrangements. However, hours later, the boys’ eyes opened and his chest began to move up and down. At the insistence of his parents, doctors performed more tests and determined that the boy was in fact still alive.

The family has filed a lawsuit against the hospital as well as two physicians for their negligence and for causing the family to suffer emotional distress. The young boy was deprived of oxygen after doctors declared him dead. His family says he has suffered permanent damage as a result.

The hospital denies any wrongdoing. Officials say proper procedures were followed.
