Family blames hospital for son’s developmental disorders and wins

It is important for doctors in New York City and beyond to provide their patients with proper treatment. In many cases, that means taking action in a timely manner. A matter of minutes may be the difference between life and death. In one family’s case, a couple of hours kept them from a normal life with their child.

One hospital was recently found to be guilty of negligence after doctors failed to perform a cesarean section in an appropriate amount of time. The family who filed the lawsuit believes their 2-year-old son’s severe developmental disorders were a direct result of the hospital staff’s delayed action.

The family’s son was born in March 2010. They had intended to deliver the baby at home. However, complications forced them to go to the hospital. When the mother arrived at John Hopkins Hospital, an emergency C-section was ordered but did not take place until two hours later.

After a three-week trial, jurors sided with the family and awarded them $55 million.

Despite the verdict, officials with John Hopkins Hospital maintain that hospital staff provided appropriate care. They say they plan to appeal the jury’s decision.

Doctors have a duty to provide their patients with the best care possible. When they fail to do that, they may be held responsible through a medical malpractice lawsuit.
